The Department of Justice yesterday notified the State of Colorado that it unnecessarily segregates individuals with physical disabilities, including older adults, in nursing facilities, in violation of Title II of the Americans with Disabilities Act and the Supreme Court’s decision in Olmstead v. L.C. The department’s findings follow a thorough and multi-year investigation into the state’s system of care for people with physical disabilities. State officials have cooperated with the investigation, and the Department looks forward to further conversations with Colorado about how best to remedy the violations uncovered.
